Terms & Conditions


1. Copyright

a) The Copyright Designs and Patents Acts 1988 assign the copyright of the images to the photographer (Frédérique Cifuentes). The Photographer grants The Client permission to make copies of the images under the conditions that the images taken by the Photographer are for personal use by The Client and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from The Photographer.b) The Photographer’s name must be printed on or in reasonable proximity to all published reproductions of the Photographs.

c) The client(s) hereby allow(s) the photographer – Frederique Cifuentes to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, social media, websites, blogs, sample albums and prints, venue and other vendor samples, and other such material, providing that the images used are used lawfully and without damage to the client(s).

2. Payments

a) Client agrees to pay the Photographer the full amount for the photography session as listed in this contract, and agrees to pay any additional fees for final photography prints or products as detailed on the additional page of this contract, (if applicable). Booking is subject to the payment of a 30% deposit and the signing of this contract. The booking fee is payable within 10 working days from the date of booking. After this time the reservation will be automatically removed and the date will become open for booking. The booking fee will be deducted from the cost of the client’s chosen package when calculating the final balance due. Upon payment of the Booking Fee, The Photographer will reserve the event date on behalf of The Client(s) and reject all other requests for event coverage on that date.

b) The balance of your package cost is to be paid 1 MONTH BEFORE THE WEDDING DAY. In the event that The Client fails to pay the remaining balance within seven (7) days of the wedding date, The Photographer may, at their discretion, treat this agreement as if terminated by The Client.

c) Prints, albums, wall-art to be paid on the day of your order. Non-receipt of the full balance by the due date will be deemed cancellation of the contract by the client(s).

d) Payment can be made in cash, cheque, bank transfer (BACS) or Paypal. No final versions of images will be released to Clients until payment has been received in full.

e) Client will have the opportunity to purchase final photography prints or products after the session. Photographer will provide proofs from the session to Client for review. Client agrees to purchase any desired images at the prices set forth in the pricing table on the additional page of this contract, (if applicable).

3. Coverage

a) Client agrees that Photographer cannot guarantee certain poses during the photography session. Additionally, Client agrees not to hold Photographer liable for compromised or poor quality images due to lack of cooperation by image subjects. The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed.

b) Photographs taken during the course of the event will be at the discretion of the photographer(s) although every effort will be made to comply with The Client(s) requirements.

c) For a wedding or other event booking the photographer(s) shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of the event, some moments might not be recorded, or not recorded for logistical reasons.

d) Photographs shall be made in digital format and shall be of a style and quality generally similar to photographs visible on Photographer’s portfolio website. The Client acknowledges that they are familiar with The Photographer’s portfolio and are requesting services with knowledge of The Photographer’s style; that The Photographer’s work is constantly evolving; that The Photographer’s services are of unique and artistic nature; that the photos may be different from photographs taken by The Photographer in the past; and that in creating the photos, The Photographer shall use his personal artistic judgment to create images consistent with his personal vision of the event, which vision may be different from The Client’s and the subject’s vision of the event. Accordingly, The Client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria.

4. Force Majeure

a) The due performance of the contract is subject to alteration or cancellation by the photographer(s) owing to any cause beyond their reasonable control (e.g sudden illness/injury/ victim of crime, flooding).

b) The photographer(s) may contact other photographers in the event that they are not able to attend your booking due to clause 4a). However it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.

c) In the event of cancellation by the photographer(s), or in the unlikely event of total photographic failure (although re-shoots may be arranged if practicable) the photographer(s) will not be responsible for costs in order to stage re-shoots. The photographer(s) liability shall be limited to a full refund of any deposits and fees paid.

5. Cancellation Fees, date and package changes

a) In the event that you do need to cancel / postpone your photo shoot, we require at least 60 days notice of cancellation and rescheduling required for all photographic appointments:

– 60 days before the wedding 50% refund of all monies paid
– 61-90 days before the wedding 75% refund of all monies paid
– 91-120 days before the wedding 100% refund of all monies paid

b) The Photographer must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of event. Notification of any changes can be made by phone along with written notice sent via email for documentation. If an email is sent, a confirmation of receipt must be sent back by the Photographer in writing or via email. It is the client’s responsibility to confirm all arrangements at least 7-10 days prior to the event.

6. Placing an Order and Receipt of Goods

a) Any alterations to orders must be notified either by phone or email and confirmed in writing (sent by Royal Mail special delivery) within three working days of the order being placed. The photographer will not be held liable for any costs incurred due to alterations to the order made by the client after this time. Email is not a reliable method of notification due to the unpredictable operation of message scanners. You MUST request and receive a confirmation by email if you choose to use this method.

b) The Photographer will aim to deliver all images within 21 – 28 days after the date of the wedding. The main wedding image print and albums order may take up to six weeks to complete. Once a set of high resolution digital files have been delivered, the responsibility to preserve the images passes to The Client, and the decision whether The Photographer will keep a copy or not will be entirely at The Photographer’s discretion.c) Any complaints must be received in writing within seven days of receipt of products purchased. This includes photographs, USB, albums, frames and any other special services that have been agreed. No returns nor any refunds will be accepted after seven days of delivery of purchased services or products.

7. Client Confidentiality

The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to her in confidence for the purposes of the Photography, save as may be reasonably necessary to enable the Photographer to carry out her obligations in relation to the commission.

8. Insurance & Limitation of Liability

a) The Photographer(s) will maintain Public Liability and Professional Indemnity insurance at all times. However, in the unlikely event of a total photographic failure or cancellation of this Contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the Contract. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of 75% of fees paid for the service or part thereof according to the percentage of images supplied. Neither party shall be liable for any indirect or consequential loss.b) The Photographer shall not be liable to the Client for any loss of profit, loss of contracts, loss of business or revenues, loss of production or for any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of the Photographer, the Photographer’s assistants or otherwise) which arise out of or in connection with the shoot.

c) The client is responsible for his/ her own safety during the photo session.

9. Applicable law

This agreement shall be governed by the laws of England & Wales and subject to the exclusive jurisdiction of the English Courts. By booking a photographic / video session with Ray Of Light Studio you are agreeing to all the above terms and conditions.

10. Miscellaneous

a) The Photographer will not tolerate verbal or physical abuse. If the Photographer is threatened in any way or if the conduct of any of the guests damages the equipment of the Photographer, it will result in the early or immediate departure of the Photographer. The Client understands that in such an event, no refunds will be granted.

b) The Client kindly agrees to provide the Photographer (& assistant/second shooter if applicable) with one meal on the day of the wedding, either seated with guests or in a room separated from the wedding guests/dining area.

c) In the event of any dispute regarding this contract, both parties agree to attempt to obtain a conciliation before taking any other action.
